PRICE OF ITEMS

The prices applicable to the products are those shown at the time of the order and all are inclusive of taxes (VAT or similar). The breakdown of these taxes will be broken down before the completion and formalization of the order. You must take into account that when you formalize the order, the system will inform you in detail of the total taxable amount of the order, the applicable taxes and the corresponding shipping costs.

Taxes, fees and shipping costs will vary depending on the fiscal or physical area from where the order is made or has to be sent so it can be modified or discounted after selecting the shipping area.

Offers or discount vouchers may have an expiry date after which they are no longer valid.

The prices displayed on the platform may be reviewed and modified at any time as they are subject to changes that occur in the market.

PAYMENT METHODS

The purchases of products and services may be paid by credit or debit card in the purchase section or formalization of the same through Electronic POS enabled for this purpose.

Payment by credit or debit card

If you would like to pay for your purchase by credit or debit card the payment will be managed through a secure server payment gateway.

All your data will travel encrypted and on a secure server SSL ("Security Socket Layers"), guarantees that neither the owners of this Virtual Commerce, nor third parties, will have access to your bank details, or credit card.

Afterwards, the bank will validate your credit card and proceed to the payment. At that moment the order will be effective and will be processed and shipped.

SHIPPING AND DELIVERY

The products that appear on the website with their unit price corresponds to the total price, including taxes and does not include transport and customs costs.

Shipping and customs costs will be borne by the customer, informing him at all times before accepting the order. The products purchased will be delivered to the person/company and at the address indicated, within the period indicated for each type of shipment.

Shipments will be delivered in approximately 1 - 2 days for the national territory from receipt of payment and subject to stock availability.

For the delivery of the order, Saturdays, Sundays and holidays (both national and local) will not be counted.

If the product is not in stock the delivery time may be delayed depending on the time it takes our suppliers to replenish it. In this case, Noumad, declines all responsibility and will inform the customer of the estimated time of receipt by us.

Orders will not be served in post office boxes and reserves the right to withhold shipment of orders with wrong addresses. Our customer service department will contact you according to the data provided for any incident or doubt that may arise in the processing of your order.

AVAILABILITY

NOuMAD will do its best to satisfy all its customers in the demand of the products.
In case of unavailability of the product after the order has been placed, the customer will be informed of the cancellation of the order.

SHIPPING COSTS

NOuMAD currently ships throughout Europe and in the Spanish territory: Peninsula and Balearic Islands. For now we do not ship to the Canary Islands, Ceuta and Melilla.

Spain (mainland and Balearic Islands): free shipping from 200 ¤, otherwise the cost is 5,90 ¤.
Rest of Europe:
Portugal, Andorra, France-South, Gibraltar: 10 ¤
Andorra, Belgium, France-Rest, Holland, Luxembourg, Italy-North, Germany, Austria, Italy-South, United Kingdom: 21 ¤

Note-Aduanas:

The sale of our products outside the Peninsular territory to countries of the European Union, are exempt from VAT (except if the total value of annual sales to that country is below the limit set by its authorities). However, the customs system will apply the tax charges corresponding to each customs office that will always be charged to the customer and at the time of delivery of the package. We cannot calculate the amount to be paid a priori, as they depend on the regulatory bodies of each of the destination countries and their customs.

RETURNS

If for any reason you are not satisfied with your order, you have a period of 14 calendar days, counting from the date of delivery of the order, to return it (According to Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November).

Due to the nature of the orders and in accordance with Article 45 of Law 7/1996 of 15 January on Retail Trade, there will be no right of return in the case of those goods manufactured according to customer specifications or that have been clearly made to measure for the same or that as a result of their state or condition do not meet the conditions suitable for their return.

The company guarantees that the services will be performed in accordance with the terms set out in the offer. It also undertakes to remedy any defect that is a direct consequence of improper provision of the services. For these purposes, the following rules shall be taken into account:

(a) When the effect consists of a defect in the delivered product, the remedy shall consist, as far as possible, in the repair or replacement of the defective product;
(b) When, due to the nature of the service, the repair or replacement of the defective product is not possible, the customer shall be offered the most favourable technical and economic solution.
(c) Alternatively, if the remedy in accordance with the rules set out in paragraphs (a) and (b) above is not satisfactory, the customer shall be entitled to demand a reduction in the price or terminate the contract, with a refund of the price paid.

The company reserves the right to examine the defects alleged by the customer.

The company's liability is limited to the remedy of defects. The company shall not be liable for any incidental damages that may arise from the performance of the services. This includes, but is not limited to, damages for loss of data, files, images, information, opportunities or profits and moral damages.

No liability shall be assumed for colour differences between the original image and that of the delivered product caused by a defective quality of the original image file. Claims based on aesthetic taste shall not be considered as defects.

The guarantees and responsibilities provided for in this clause shall not apply when the damage or defect is due to force majeure or a cause attributable to the customer. In any case, the warranty provided herein replaces any other warranties.

The regime provided for in this clause shall not be enforceable against persons acting as consumers under Spanish law, provided that a Judge or Court considers that the limitations provided herein are contrary to the basic rights of the consumer. The same rule shall apply in cases where fraud or gross negligence is found in the performance of the services.

As a customer, you are liable to the company and to third parties who hold industrial or intellectual property rights as a result of your use of our services. You shall also indemnify these persons against claims by third parties.

If you wish to make a return, please check that you meet all of the following requirements before sending the product to us:

The product must be accompanied by its original packaging and properly sealed.

To make a return, please send an email to the following address: shop@noumad.com, indicating your personal data, order number and disagreement with the order so that we can proceed to authorize the return. Once we receive this email, we will tell you how to make the return. Without prior authorization from us, the product will not be accepted and consequently will be returned to its origin, bearing the shipping costs the customer himself.

Once we receive the goods, we will check that all the aforementioned requirements are met and in case of conformity, Noumad, will proceed to exchange the item for another or refund the money, if requested by the customer.

If the return is the result of an error in the preparation or products in poor condition, the return shipping costs will be borne by us. On the other hand, if the return is for any other reason, the return shipping costs will be borne by the customer.

We recommend checking the order at the time of delivery by the transport agency, and record it on the delivery note and sign it.

WARRANTY

The guarantees and after-sales services are governed by the Royal Legislative Decree 1/2007 of 16 November which approves the text of the General Law for the Defence of Consumers and Users. According to this regulation, the seller is obliged to deliver to the consumer and user products that are in accordance with the contract, responding to him for any lack of conformity.

MODIFICATION OF THE GENERAL CONDITIONS OF SALE

Noumad, reserves the right to modify the general conditions of sale without prior notice, and may change, delete or add content and services provided through the same as the way in which they appear presented or located on their servers.
These changes must be accepted by the user through the Noumad website.
Customers who do not agree with the changes to the general conditions, must notify Noumad. In the event that any of the terms of the general conditions is illegal or unenforceable, it will be null and void and will be applied as agreed by the parties and in the absence of the Spanish Civil Code.

TERMS OF USE

To consult and search for the products of your interest, you can do it through the different navigation menus or by means of the advanced search.

The products appear with their unit price which corresponds to the total price including VAT, excluding transport costs and customs where applicable.

Shipments will be delivered in approximately 1-2 days for the national territory from receipt of payment and according to stock availability.

LIABILITY, LITIGATION AND APPLICABLE LAW

Noumad cannot be held responsible for the non-performance of the contract concluded in case of stock shortage or unavailability of the product, force majeure, total or partial disruption or strike, in particular of postal services and means of transport and/or communications, flood or fire. In case of dispute, the member shall contact Noumad as a matter of priority in order to obtain an amicable solution.

These general terms and conditions of sale shall be interpreted in the Spanish language and shall be carried out in accordance with Spanish law.

For the resolution of all disputes or questions relating to this website or the activities developed in it, will apply Spanish law, to which the parties submit themselves, being competent for the resolution of all disputes arising from or related to its use the Courts and Tribunals of the city of the person responsible for the file.
